It is agreed that:

1. The instructor will make his/her services as an instructor available to the pupil for the sole purpose of giving the pupil driving tuition at the rate per lesson for the pre-arranged time agreed.

2. In the event that the instructor is unable to attend for a specific appointment, or in the event of a mechanical breakdown or other cause, the instructor reserves the right to re-arrange the lesson to a time convenient to both parties.

3. The instructor will carry motor vehicle insurance covering the pupil whilst driving the tuition vehicle accompanied by an instructor or a Driving Standards Agency examiner.

4. The lesson fee will be paid at end of, or in advance of, each lesson.

5. If the pupil fails to give the instructor a minimum of one working days notice cancelling any lesson, the pupil shall be liable for the lesson fee in respect of such lesson.

6. The pupil confirms that he/she is duly licensed to drive the tuition vehicle.

7. Aspect Driver Training cannot guarantee that you will be at a high enough standard to take your practicable test after your course due to differing individual learning needs.

8. The candidate must reach a standard considered safe by the instructor before being allowed to take the tuition vehicle and/or trailer on Driving Test, your experience and standard of driving or towing and driving will be discussed when booking your course, the decision will be which course best suits you. The decision of the instructor providing the tuition for the course would be final. This would be in the interest of other road users and the examiners conducting Tests on behalf of the DSA (Driving Standards Agency). We at Aspect Driver Training DO NOT refund any Test fee whatsoever.

9. Aspect Driver Training will not be held responsible for cancellation of Tests due to unforeseen circumstances beyond our control.

10. Please ensure that any candidate Must have the correct documentation, both parts of your licence, if you hold a paper licence only, you are able to use your passport. Failure to provide these would result in the Test not being conducted by the DSA. However the candidate will still have to pay for the completed course in Full.

11. No refunds of money will be paid unless 21 days clear working days notice have been given. If for any reason you should wish to change dates of your course, this may incur a small charge (admin)

12. Deposits are non Returnable one course dates are confirmed or tests booked

13. Your test will be booked at any of our LGV Test centres. It may be necessary for us to change the test centre in order to fit in with other arrangements. You Must not change or Cancel the Test without notifying the Driver Training office first. Trailer Courses Only

14. Aspect Driver Training will not except any responsibility if you were to fail your test, we guarantee that Aspect Driver Training will get you up to the standard in order for you to pass your B+E test with Qualified DSA Instructors.

15. Due to the Data Protection Act we at Aspect Driver Training will not discuss or share any of your personal information, your information is in our Diary and kept in locked filing cabinet and will not be shared by anyone else except the person you are booking the course with.

16. If any candidate shows any signs of abusive behaviour or other conduct to the instructor it will Not be tolerated and the course would be terminated without notice. Aspect Driver Training will not be held responsible for any losses incurred to misconduct

17. Once a booking has been accepted either verbally, in person, over the phone or in writing, cancellation of the agreed joining instructions by a customer 10 working days or more prior to the commencement of the course will incur an administration charge of 25% excluding VAT. Cancellation within 10 working days by a customer prior to the course date will result in the entire course fee being charged unless superseded by a variation to the terms and conditions of business specified for that course. Substitution of course delegates will be accepted upon reasonable notice being given and the original joining instructions and fee will be deemed acceptable. All cancellations must be in writing, verbal cancellations are not acceptable and proof of posting is recommended.

18. Payment of all course fees must be made prior to the commencement of the course unless other arrangements have been mutually agreed with Aspect Driver Training. cheques accompanying should be made payable to "Aspect". Aspect Driver Training reserve the right through non payment by the customer prior to the course to cancel the joining instructions and offer the place elsewhere. Where a customer has paid a deposit, the full balance is due payable 10 working days prior to the course commencing. Unless other arrangements have been made, failure to pay the balance could result in the course being canceled and the full charges being incurred.

19. Any variation to the joining instructions, course dates, times of attendance ect, made by Aspect Driver Training will be notified to the customer. Aspect Driver Training will make every effort to ensure that the original instructions are complied with. In the event of course/delegate cancellation made by Aspect Driver Training every endeavor will be made for the delegate to attend the next available course. All incidents and actions including any money refunds are dealt with promptly and fairly in compliance with the company's quality process.

20. Every effort is made to ensure that both instruction, handouts, course notes given are true and correct at the time but Aspect Driver Training does not accept any responsibility for error or omissions.

21  Any delegates attending Aspect Driver Training's premises including vehicles are required to adhere to any notices or instructions given to them by Aspect Driver Training staff. Aspect Driver Training does not accept ant responsibility for personal belongings or vehicle's left on the premises.

22. Unless specified arrangements are made for course refreshments by Aspect Driver Training, refreshments during the course will be the delegates responsibility.

23. Where external examinations are involved and the delegate for enrolment has supplied details, Aspect Driver Training cannot accept responsibility for the accuracy if a dispute should arise with the examination's body.

24. It is important that adequate provision is made to ensure that drivers attending courses are able to comply with the rest requirements laid down in the drivers hours regulations.

25. Special needs, the company will endeavor to provide training wherever and whenever practical to do so having first assessed the applicants capability to receive instruction which does not compromise the Health and Safety of its workforce, general public and the individual themselves. For a person who falls in to this category of requiring special needs, the company's normal standard tariff quoted in its course guide does not apply and each request will be priced on an individual basis and subject to whatever is recommended at the time against need. The company retains the right to refuse to train any person who in it's professional belief will not be able to reach the required standards of that prescribed either by the HSE or the DSA having firstly assessed the person.

The above terms and conditions are binding on acceptance of the joining instructions and supersede any terms and conditions that the customer may with to impose, no variation may be made without specific signed agreement with the management of Aspect Driver Training.
